Plain-English summary: We're Up Your Performance ("UYP"), a youth basketball program based in Orange County, California. 2. Information We Collect
Information you provide
- Contact information: full name, email address, phone number.
- Athlete information: your child's grade, school, playing experience, and goals (collected on calls or in follow-up communications).
- Inquiry information: answers to any qualifying questions on our forms (for example, whether an inquiry is for an athlete in grades 6–12).
- Communications: the content of emails, SMS messages, calls, and in-app messages you send us.
- Payment information: if you register for a program, payment is processed by our third-party payment processor. We do not store full card numbers.
Information collected automatically
- Device and usage data: IP address, browser type, pages viewed, referring URL, and time stamps when you visit our website.
- Cookies and tracking pixels: including the Meta (Facebook/Instagram) Pixel and similar technologies used to measure ad performance and deliver relevant ads.
Information from third parties
- Meta Lead Forms: when you submit a lead form on Facebook or Instagram, Meta shares with us the name, email, phone number, and answers you provided.
- Service providers: we may receive information from our CRM (Go High Level), email provider, SMS provider, and analytics tools.

- To contact you about UYP programs, including the Phil Handy clinic, High School / College Prep, Skills, Camps, and Friday Night Hoops (FNH).
- To send you scheduling confirmations, program updates, and follow-up communications by email, SMS, and phone.
- To register, run, and improve our programs.
- To measure and optimize our advertising on Meta and other platforms.
- To comply with legal obligations and protect our rights.
4. How We Share Your Information
We do not sell your personal information. We share information only as described below:
- Service providers who help us operate our business: our CRM (Go High Level), email platform, SMS provider, ad platforms (Meta), payment processor, and website hosting. These providers are contractually required to use your information only to provide services to us.
- Legal and safety: if required by law, subpoena, or to protect the rights, property, or safety of UYP, our participants, or others.
- Business transfers: in connection with a merger, acquisition, or sale of all or part of our business.
5. Meta (Facebook and Instagram) Lead Forms and Pixel
We run advertisements on Meta platforms that may include "Instant Forms" (Lead Ads). When you submit one of these forms, Meta collects the information you provide and shares it with us. Meta's use of your information is governed by Meta's own Data Policy.
We also use the Meta Pixel and similar technologies on our website to measure the effectiveness of our ads and to show relevant ads to people who have visited our site or engaged with our content. You can manage your ad preferences in your Meta account settings.
6. Text Message (SMS) and Phone Communications
By providing your phone number on our forms, on our website, or in response to our ads, you expressly consent to receive phone calls and SMS text messages from UYP related to your inquiry, including scheduling and program information. Message and data rates may apply. You can opt out of SMS at any time by replying STOP to any text message. You can opt out of phone calls by telling the caller you no longer wish to receive calls.
Opting out of marketing SMS or calls does not prevent us from contacting you about an active registration or urgent program matter.
7. Cookies and Tracking Technologies
We use cookies, pixels, and similar technologies to operate our website, understand usage, and measure advertising performance. You can control cookies through your browser settings. Disabling cookies may limit some features of our website.

9. Children's Privacy
Our services are directed to parents and guardians inquiring on behalf of youth athletes. Our forms and advertisements are intended for adults (18+). We do not knowingly collect personal information directly from children under 13. When a parent or guardian provides information about a minor athlete (for example, grade, school, or playing experience) as part of an inquiry or registration, we use that information only to provide the program requested.
If you believe a child has provided personal information to us without parental consent, please contact info@upyourperformance.org and we will delete the information.
10. Data Retention
We retain personal information for as long as needed to provide our services, communicate with you about your inquiry or registration, comply with legal obligations, and resolve disputes. When information is no longer needed, we delete or anonymize it.
11. Data Security
We use commercially reasonable administrative, technical, and physical safeguards to protect your information. No method of transmission or storage is 100% secure, so we cannot guarantee absolute security.
12. Third-Party Links
Our website, emails, and ads may link to third-party sites. We are not responsible for the privacy practices of those sites. Review their privacy policies before providing any information.
